Toboggan competition in partnership with La Sambuy

ART. 1 – Organising company

The Annecy-ville.fr website is published by the company LaVisibilite.com SASU with a capital of €19,450 and whose registered office is located at 22 route de Nanfray, 74960 Annecy. This company is registered in the Annecy Trade and Companies Register under number 824 941 298.

Organises during the year 2022 a free competition with no obligation to buy, according to the terms and conditions described in these rules.

These contests are not organised or sponsored by Facebook, Instagram, Google, Apple or Microsoft. Facebook and Instagram shall not be held responsible for any breach of the law in its terms and/or conduct. Facebook and Instagram are not associated with these games. The organising company therefore discharges Facebook and Instagram from any responsibility regarding all elements related to any game, its organisation and its promotion. The personal data collected is intended for the organising company and not for Facebook, Instagram, Google, Apple or Microsoft.

ART. 2 – Conditions of participation

These competitions are free of charge and open only to private individuals of legal age, residing in metropolitan France, with internet access and a valid email address, and a Facebook account.

Professionals of any kind (retailers, stockists, etc.) and staff of the organising companies, as well as their families (spouse, direct ascendants and descendants, brothers and sisters), regardless of where they live, and all persons who have participated in the preparation of the competitions, are not eligible to participate. The company reserves the right to carry out all necessary checks on the identity, postal address and/or e-mail address of participants.

The competitions are subject to the regulations of French law applicable to games and competitions. Any participation in the competitions on plain paper, by mail, by telephone or in any other form will not be taken into account.

The mere fact of participating in this game implies pure and simple acceptance, without reservation, of these rules. Only one entry per person is authorised – same surname, same first name, same e-mail address and/or Facebook login – for the entire period of the competition.

ART. 3 – Participation procedures

These competitions take place exclusively on the Annecy Ville Facebook page, which can be accessed at https://www.facebook.com/annecy.ville.9/ during the specified competition period.

To participate in a contest on the Facebook page, the participant must

  • Have a valid Facebook account

  • Go to the Annecy Ville Facebook fan page, accessible at https://www.facebook.com/annecy.ville.9/, then to the publication dedicated to the contest

  • “Like” (i.e. click on the “Like” button) the competition publication on the Annecy Ville page

  • Follow the detailed participation instructions in the dedicated publication.

Registration for the prize draw is only effective once these steps have been completed. The participation dates for each competition are indicated on the publication dedicated to the competition.

ART. 4 Designation of winners

The winners shall be determined by a draw, from among the entries declared as valid. The draw will be carried out within 7 days of the end of the competition, on the date mentioned in the publication dedicated to the competition.

The draw will be carried out by the organiser, Annecy Ville, at its head office, 22 route de Nanfray – 74960 Annecy.

Participants authorise the verification of their identity.

Failure to comply with these rules, as well as any fraud or attempted cheating, whatever the method, will result in the pure and simple elimination of the author’s participation.

In the event of suspected fraud or unfair participation, the organising company reserves the right to carry out any verification it deems useful. Any proven fraudulent or unfair manoeuvre will result in the immediate and definitive disqualification of the participant without notice. In the event of a dispute, only the data held by the organising company will be deemed authentic. The organising company may in no case be held responsible if the information it may have obtained within the framework of these procedures concerning the identity, e-mail address, postal address or any other element is not accurate or up to date.

ART. 5 – Prizes

The number of winners for each competition will be indicated in the publication dedicated to the current competition. Each winner shall win the prize indicated in the publication dedicated to the current competition. The prize may not be exchanged for its cash value or for any other prize. The organising company cannot be held responsible for the use or non-use, or even the trading or loss of the prize by the winner. The organising company reserves the right to verify the age of any winner before awarding the prize. The organising company reserves the right to replace the prize won by a prize of equivalent nature and value.

There are two prizes to be won. One is a voucher for a sledging activity at La Sambuy for 1 or 2 people. The vouchers were issued on 02/12/2022 and are valid for one year. They can be exchanged at the La Sambuy ski lift ticket office.

ART. 6 – Conditions of delivery of the prizes

Each winner will be contacted within 7 days following the draw by the organising company to confirm the nature of the prize won and the procedures to follow to benefit from it, via :

  • A private Facebook message, when the competition is held on the Annecy Ville Facebook page

The winner will then have to provide his/her full contact details (surname, first name, date of birth, telephone number, email address and postal address) in response to the said message from the organising company.

Any winner who does not reply within 7 days of the notification of his/her prize by the organising company will be considered to have renounced his/her prize. The winner will then forfeit his/her right and the prize will become the property of the organiser and may be awarded to a new winner.

It is reminded that if the winner’s details are invalid, incomplete or erroneous, he/she will lose the benefit of his/her prize. The prize shall be sent to the winner by post, by recorded delivery or Colissimo, to the postal address indicated by the winner.

The Organising Company shall not be held responsible in the event of loss or theft of the letter or package by the postal services.

The prizes will be sent by post to the winners within 30 days.

ART. 7 – Modification of the competition

The organising company shall not be held responsible if, in the event of force majeure or any other cause, the competition is postponed, shortened or cancelled. The organising company also reserves the right to extend or limit the participation period, to postpone it or to modify the conditions, and cannot be held responsible in this regard. Additions and modifications to these rules may be published during the competition. They will be considered as annexes to these rules.

ART. 8 – Authorisation to distribute participants’ images

By participating in the competition, the participant authorises the organiser to use his/her surname, first name, as well as the indication of his/her town and department of residence, in any publicity or promotional event, on the website and the Facebook page, as well as on any affiliated website or medium, without this use giving rise to any right or remuneration other than the prize offered for this operation.

Participation in this operation implies authorisation for the organising company to reproduce and exploit the participants’ entries, names and images on all media (website, Facebook page, written press, etc.) for the purposes of promoting the operation, in the year following the operation. This use will not give rise to any consideration other than the benefit of the prize.

Participants acknowledge that the use of their image does not constitute any obligation for the organiser of the operation.

Participants acknowledge and accept the characteristics of the Facebook site, which allows and authorises in certain circumstances the dissemination of content posted by participants and personal information about them.

The organising company shall not be liable in any way whatsoever in this respect.

ART. 9 – Privacy

This article takes into account the rules on personal protection imposed by the General Data Protection Regulation (GDPR) dated 25 May 2018. Only the information necessary for the proper conduct of this game and for the delivery of prizes in the event of winning is collected. The purpose of this article is to give you all the useful information on the collection, use and recipients of your personal data.

  • PARTICIPATION IN THE GAME

The personal data of each participant is collected as part of each operation in order to participate in the competition and to respond to complaints and requests for information.

  • PERSONAL DATA COLLECTED

This is only the registration data necessary for the proper conduct of the game, namely:

This information is not recorded or saved in a computer file, but is necessary to take into account their participation.

If the participant is declared the winner of the competition: This is only the data required to award the prize, namely :

– surname

– first name

– postal address (postcode, town, telephone number, date of birth, e-mail address)

This information is not recorded or saved in a computer file, but is necessary for the awarding of the gift vouchers in order to justify their delivery.

  • RECIPIENTS OF PERSONAL DATA

The personal information collected is only used in the context of the current competition. It will only be used by the Organising Company to ensure the smooth running of the game, the designation of the winner and the distribution of the prize. Your data will remain confidential and will not be used for commercial solicitation.

  • DURATION OF STORAGE OF PERSONAL DATA

Personal data will be kept until the end of the game and the effective distribution of the prizes as stated in these rules and in accordance with the Law.

The company ensures compliance with regulations. We protect the rights of the participants whose data we hold. Our storage servers are reliable and secure. We protect your data from loss, alteration, damage or misuse. We undertake to comply with French and European legislation on the collection and processing of personal data to ensure their protection, security and confidentiality.

  • PARTICIPANTS’ RIGHT TO THEIR PERSONAL DATA

In accordance with Law n°78-17 of January 6, 1978, as amended, and as of its entry into force on May 25, 2018 of the General Data Protection Regulation n°2016/679, each participant has the right to access, rectify, and delete his/her personal data. Indeed, under Article 15 paragraph 1 GDPR, you have the right to obtain free of charge information on the personal data concerning you that have been stored.

In addition, you have a right to rectification (Article 16 GDPR), a right to erasure (Article 17 GDPR) and a right to restriction of processing (Article 18 GDPR) of your personal data. You may also ask any questions you may have concerning the collection, processing and use of your personal data by sending a letter to the same address, to the person responsible for processing.

ART. 10 – Responsibilities and complaints

No telephone request or complaint concerning the application or interpretation of these rules will be answered. Any dispute or claim relating to the operation must be made by registered letter with acknowledgement of receipt, sent within a maximum of 7 days, as evidenced by the postmark, after the end date of the competition to the organiser’s address.

This letter must indicate the precise date of participation in the operation, the participant’s full contact details and the exact reason for the dispute. No other method of dispute or claim can be taken into account. The costs of participation (in particular and not exhaustively, the possible costs of internet connection, postage, request for the present rules, etc.) remain the responsibility of the participant.

Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misuse or piracy and the risk of contamination by any viruses circulating on the network.

The organising company declines all direct or indirect responsibility in the event of misuse or incident linked to the use of the computer, access to the Internet, maintenance or malfunction of the game servers, the telephone line or any other technical connection, or the sending of forms to an incorrect or incomplete address. It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack.

The connection of any person to the site and the participation of players in the competition is done under their entire responsibility. The organising company may not be held responsible for the fraudulent use of a participant’s connection rights or the awarding of prizes, unless it can be shown that the organising company is guilty of gross negligence. The organising company reserves the right to disqualify any participant who interferes with the contest registration process and to cancel, shorten, modify, postpone, extend or suspend a contest, in the event that the game’s computer servers malfunction, particularly as a result of bugs, alteration, unauthorised intervention, fraud, technical anomalies or any other cause due to the participant’s fault and which would affect the administration, security, fairness, integrity or proper conduct of the contest.

The organising company shall make its best efforts to allow access to the competition.

ART. 11 – Acceptance of the rules

Participation in the operation implies full and complete acceptance of these rules. Any practical difficulties in interpreting or applying these rules shall be settled by the organiser.

ART. 12 – Applicable law

These rules are subject to French law. In order to be taken into account, any disputes relating to the operation must be made in writing to the address of the organiser of the operation in accordance with article 10 of these rules. In the event of a persistent disagreement on the application or interpretation of these rules and in the absence of an amicable agreement, any dispute shall be submitted to the Court having jurisdiction, to which exclusive competence is attributed.

ART. 13 – Consultation of the rules

These rules may be obtained free of charge on request from Annecy Ville, by private message via the Facebook page.
